Protection of Sexual Exploitation and Abuse (PSEA)

Junior Achievement Europe (JAE) is committed to the protection of sexual exploitation and abuse (PSEA). JAE has established comprehensive procedures to ensure the organization operates promoting the values of well-being and safety of everyone.  

JAE provides a safe environment in all its projects, online, offline and hybrid events, there are principles to ensure the security of everyone involved. Values of respect, inclusivity and safety are promoting as a vital component of the operation.  

JA Europe has a zero-tolerance policy against sexual exploitation and abuse incidents and provides a confidential reporting channel. Any inappropriate behavior will be treated accordingly the JAE policy and special authorities will involve if needed.

Whistleblowers Protection

JA Europe offers whistleblower protection, committed to provide a secure environment for all individuals involved in JA Europe programs and events. We encourage reporting any concern relevant to misconducts and incidents that threaten the well-being of any individual.  

Whistleblowers Protection supports confidentiality and anonymity throughout the reporting and investigation period. Protection from retaliation and dismissal while offering legal protection, in any individual who reports in good faith.

Investigation process for safeguarding issues

JA Europe has a comprehensive investigation process that follows to handle incidents that insult and threat well-being and security of any individual. The commitment to transparency and confidentiality throughout the whole investigation process is a key value for the organization.

In case of official incident report the PSEA team of JA Europe safeguarding@jaeurope.org and the PSEA team has to, within 24 hours, confirm the receipt of complaint. 

Upon receipt of the complaint, the PSEA team ensures that any victim is referred for assistance immediately (usually within 24 to 48 hours) following a disclosure in accordance with the applicable victim-centered principles.

 

The PSEA team of JA Europe upon confirmation of the reported incident has 72 hours to open and proceed with an investigation (internal and external as applicable) and send an official response to the person who has reported the incident. 

When the investigation process is complete, the responsible team gathers all the evidence that has been collected through the process. First an impartial review is carried out, to evaluate the information and compare it with the report that has been made. During the evaluation of the evidence, the team must keep high moral values such as transparency and fairness, while at the same time they need to show compliance with the legal regulations. Sanctions will be related to the degree and the gravity of the misconduct. 

Continuous evaluation for the purpose of improving the implemented procedures is essential for the efficiency of the PSEA policy and investigation plan. JA acknowledges this vital aspect and makes the necessary improvements to facilitate the alignment of the process with the organisation’s need.

 

Reports Made in Bad Faith 

JA Europe is dedicated to establishing robust mechanisms that empower individuals to report any allegations or suspicions of misconduct. At the same time, the organization has implemented procedures to safeguard whistleblowers, fostering a culture that encourages the reporting of concerns related to unethical or illegal activities within JA Europe. This commitment extends specifically to whistleblowers who act in good faith. 

JA Europe insists that all reports be made in good faith and maintains a zero-tolerance policy towards reports made with malicious intent. If reports are knowingly made in bad faith, JA Europe will take appropriate actions to address the situation. 

Reports made in bad faith have the potential to cause harm to individuals, insult, damage reputations, and undermine the effectiveness of the whistleblower policy and procedures. JA Europe will respond by terminating any collaboration with individuals found to have submitted reports in bad faith. Additionally, the organization will pursue disciplinary actions against those intentionally submitting false reports, in accordance with the law and legal frameworks. 

To protect the integrity of the whistleblower policy, JA Europe aims to encourage faithful reporting while actively discouraging and addressing the exploitation of the reporting process. This approach ensures that the reporting system remains a tool for promoting ethical conduct and organizational integrity. 

Definitions

Safeguarding : The protection of children (under 18) from violence, exploitation, abuse and neglect‘. Article 19 of the UN Convention on the Rights of the Child provides for the protection of children in and out of the home. Extending this definition beyond children, safeguarding refers to the proactive measures and protective actions an organization has to take into consideration, to ensure the safety, well-being, and rights of individuals, especially those who are vulnerable to harm or abuse. It involves prevention, recognition, and intervention. 

Children safeguarding: A child safeguarding concern is any situation or behaviour that places a child at risk or that has the potential to harm a child, whether online or in person. This can include physical, sexual or emotional abuse, neglect, or exploitation. 

Sexual Exploitation : refers to any form of sexual activity or conduct that involves an abuse of power or authority and is intended to gratify the desires, financial gain, or other interests of the perpetrator, at the expense of another person’s dignity and rights. 

Sexual abuse :means the actual or threatened physicalintrusion of a sexual nature, whether by force or under unequal or coercive conditions. It includes sexual slavery, pornography, child abuse and sexual assault.     

Whistleblower protection: the legal safeguards and provisions designed to shield individuals who report misconduct, fraud, or other illegal or unethical activities within an organization. Aiming to encourage transparency and accountability by safeguarding whistleblowers from retaliation.
